Terms of use.

These terms govern your use of this website. They are written to be read, not to be survived: plain sentences, no defined-term thicket, and no clause that says something other than what it appears to say.

02Acceptance

Using this site means you accept these terms.

These terms apply when you browse this website, use the repayment estimator, or complete the application. If you do not agree with them, please do not use the site.

They cover the website and nothing else. If you go on to receive an advance, that transaction is governed by the contract you sign with the funding company. That is a separate document, between you and them, and these terms neither replace nor summarize it.

“We” and “us” on this page mean Atlas Business Capital.

03What this site is

An explanation and an application.

The site exists to explain how a merchant cash advance is priced and repaid, to let you estimate what one would cost, and to take a full application. That is the whole of it.

Atlas Business Capital is a broker, not a lender and not a bank. Advances are made by independent third-party funding companies, and we are paid by them when a transaction completes. A merchant cash advance is not a loan. It is the purchase of a portion of your future receivables, repaid by automatic weekly ACH debit.

No page on this site, no range, no estimate and no application you submit is an offer of finance, a quotation, an approval, or a commitment to fund. Amount, factor rate, fee and term are set by the funding company after underwriting. Same-day funding is available on qualified files; it is never promised.

Everything here is general information written for a wide audience. It is not legal, tax, accounting or financial advice, and it takes no account of your business, your obligations or your plans.

Reading this site, using the estimator, or speaking with us does not create an advisory or fiduciary relationship. Before you commit to an advance, have your own accountant or attorney read the funding company’s contract and tell you what it means for your cash flow.

05Accuracy

Every figure here is an illustration.

The numbers on this site are drawn from the published ranges we work within: advances from $15,000 to $20,000,000, factor rates of 1.20 to 1.50, terms of 5 to 18 months, and origination fees of 2% to 10% deducted at funding.

Those ranges can change, and they change without notice. We keep this site accurate and current as far as we reasonably can, but we do not warrant that every figure is correct at the moment you read it. Underwriting determines your actual amount, factor rate, fee, term and weekly payment, and the funding company decides those, not us.

06Your responsibilities

What you confirm when you apply.

Short list, and each item matters. A file built on inaccurate information wastes your time before it wastes anyone else's.

  • You are authorized to act for the business. You are at least 18 and you have authority to sign an application on behalf of the business you name.
  • What you tell us is true and complete. The information you give is accurate to the best of your knowledge, and you will tell us if it changes materially.
  • The funding is for the business. You are applying for commercial funding, not for personal, family or household finance.
  • You will use the site lawfully. No attempts to interfere with, scrape, overload or gain unauthorized access to the site, and no submitting another person’s details without their permission.

What the application asks for

It is the only form on this site, and it is a long one: owner identity including a Social Security number and date of birth, and 4 months of business bank statements and photo ID, uploaded to this website. The privacy policy sets out what becomes of all of it.

07Intellectual property

The content here belongs to us.

The text, structure, layout, typography, the Atlas wordmark and mark, and the other material on this site are owned by us or used under license, and are protected by copyright and trademark law.

You may read, print and share pages for your own business use, and you may link to any page. You may not republish the content commercially, copy the site or substantial parts of it, or use the Atlas Business Capital name or mark in a way that suggests an association we have not agreed to. Ask us in writing if you want to do something these terms do not allow. The answer is often yes.

08Third parties

We do not control the funding companies.

Third-party funding companies

We introduce your file, explain the offers that come back, and tell you what they cost in dollars. We do not set rates, fees, terms or approvals, and we are not a party to the agreement you sign with a funding company.

That agreement is between you and them, as is the funder’s conduct under it, including collection, reconciliation and early-payoff treatment. We are not responsible for the terms, conduct or contracts of third-party funding companies. Read the agreement in full before you sign it: the total dollars to repay, the exact weekly debit, the origination fee deducted at funding, and what an early payoff actually saves you.

Links to other websites

This site may link to websites we do not operate. We do not control them and we are not responsible for their content, their accuracy or their privacy practices. A link is a pointer, not an endorsement, and once you follow one you are on someone else’s terms.

09Disclaimers and liability

What we do not promise.

Written plainly on purpose. A limitation clause nobody can read is a limitation nobody agreed to.

  • The site is provided as it is. We work to keep it accurate and available. We do not promise it will be uninterrupted, error-free, or current at every moment, and we give no warranties beyond those the law does not let us exclude.
  • No outcome is promised. Nothing here is a promise of approval, of funding, of a particular rate, or of a particular timescale. Same-day funding is available on qualified files. That is a possibility, not a commitment.
  • Estimates are not liabilities. To the fullest extent the law allows, we are not liable for indirect or consequential losses: lost profits, lost business, lost data, or losses arising from a decision you made on the basis of an illustration shown here.
  • Where we are liable, liability is limited. Any liability we do have in connection with your use of this website is limited to the fullest extent the law allows.

What is never excluded

Nothing on this page limits or excludes liability for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded. Nothing here affects rights you have under consumer or commercial law that cannot be waived by agreement.

10Governing law

No governing law is stated on this page.

These terms do not name a governing law, a venue, or a dispute-resolution procedure for your use of this website. That is a decision for a lawyer and it has not been made, so the gap is left visible rather than filled with something invented.

An advance is a separate matter. The agreement you sign with a funding company sets out the law and the forum for that transaction, and nothing on this page changes what it says. Read it in full before you sign, and ask us at funding@atlasbusiness.capital if anything on this page is unclear.

11Changes

These terms will change over time.

We update this page as the site, the service and the law change. The version published here is the version that applies, and the date at the top of the page tells you when it last moved.

Continuing to use the site after a change means you accept the updated terms. We do not apply a change backwards to an application you have already sent. The terms in force when you sent it are the ones that governed it.
