01SMS terms
Reply to any message
Atlas Business Capital runs one text message program, and you are only in it if you asked to be. These are its terms, in the order you are likely to need them.
02The program
The program is the Atlas Business Capital funding program. Every message we send under it relates to an application you submitted to us.
Atlas Business Capital is a broker. We arrange merchant cash advances with third-party funding companies, and the messages in this program exist to move your file along.
Typical messages confirm that your application arrived, ask for information a funder needs, tell you where your file stands, or arrange a time to speak. That is the whole program. There is no marketing list, no newsletter, and no recurring campaign, and we do not text a number that was never given to us.
What we will never text you
03How you opt in
There is no other route into this program. We do not buy phone numbers, and we do not enroll a number that reached us for some other reason.
Whether you ticked the box is recorded on the signed application itself, with the date and time it was signed, so what you agreed to can be shown later rather than merely asserted.
The wording beside the box
I agree that Atlas Business Capital may contact me about business funding by phone, text message and email at the number and address I provided, including by automated means. Consent is not a condition of any purchase or funding. Message and data rates may apply. Reply STOP to opt out of text messages.
This page and the application print that sentence from the same source, so the two cannot drift apart.
Not a condition
Consent to receive text messages is not a condition of any purchase or of any funding. Nothing about your application, the funders we take it to, or the terms you are offered depends on whether you agree to be texted. Leave the box unticked and the application still submits. If you tick it and change your mind, reply STOP to the first message, or tell us by phone or email and we will use those instead.
04Frequency and cost
This is a conversational program, not a broadcast one. Messages are sent in response to the application you submitted and to follow up on it.
There is no fixed schedule and no set number of messages. How many you receive depends on how far your file goes and how quickly you reply. A file that is reviewed and declined may generate two or three messages. A file that proceeds to documents and an offer will generate more, spread across the days it takes.
We reply during business hours where we can. Our published hours are Mon–Fri, 9am–6pm ET.
Cost
Message and data rates may apply.
Atlas Business Capital does not charge you for text messages. Your mobile carrier may charge you for messages and data under your own plan. Check your plan if you are unsure what it costs.
05How to opt out
Send STOP as a reply to any message from us, from the number that receives them. No explanation is needed and nobody will call to talk you out of it.
You should receive a single confirmation message, and after that we will not text that number again unless you opt in a second time. If a message crosses yours in transit, reply STOP again and it will be caught. You can also ask us to stop by phone or email, and we will do it by hand.
What STOP covers
To end every channel at once, use the do-not-contact page.
06How to get help
Send HELP as a reply to any message and you will receive the name of the program, how to stop the messages, and how to reach a person.
You do not have to use the keyword. The phone number and email address beside this paragraph reach the same desk as the messages do, and a person answers both. If you receive a text that claims to be from us and something about it feels wrong, do not reply to it and do not tap anything in it. Call the number below and we will tell you whether it came from us.
Support contact
(305) 791-3797funding@atlasbusiness.capitalMon–Fri, 9am–6pm ET · We answer in under 4 business hours.
07Delivery
Text messages travel over networks that neither you nor we control, and delivery is not guaranteed.
Not every carrier, plan or handset supports every message, and a message can arrive late or not at all for reasons no party to it can see. Because of that we never let a text be the only route to something that matters. A document request, an offer or a decision is also sent by phone or email.
If your mobile number changes, tell us. Numbers are reassigned to new people, and we would rather stop messaging a number than message somebody who never applied.
What this means in practice
08Privacy
Your mobile number is used to contact you about the application you submitted, and for nothing else.
Arranging an advance means passing your application to third-party funding companies so they can consider it. That is what a broker does, and the privacy policy sets out exactly what is passed on. We do not sell your mobile number, and we do not share your number or your consent to be texted with anybody for their own marketing.
The application on this site does collect a Social Security number and a date of birth, and it takes documents as uploads. None of that is ever asked for by text, and bank login details are never asked for at all. If a message appears to want any of it, it did not come from us.

09Summary
Nothing here is new. It is the same terms set out above, compressed for review.
Ask us before you reply to it. If you would rather we stopped altogether, reply STOP to the message and it ends there.
